実家の売却 Sale of parent’s house_1

ここ数年、両親の実家の売却活動をしています。実家スペースの横に8戸の1DKの賃貸住戸がくっついた築50年超の木造アパートです。賃貸部分は3部屋以外は空室で、父が昨年他界したため現在は78歳の母が1人で管理しながら住んでいます。何度か購入希望者が現れましたが、こちらの売却条件と折り合わずに契約に至っていません。

購入希望者は全員RCのワンルーム賃貸を建てようとしている個人の不動産投資家ですが、下記の点が嫌で一歩を踏み出せないようです。

  • 賃借人が3人残っていて立退きが面倒
  • 前面道路の片側の隣地境界標が無く、隣地建物がこちらの敷地に越境している。
賃借人の立退きに関しては金銭的な方法で解決できると思いますが、長く入居してくれた賃借人に我々から立退き交渉するのは気が進まないため、売却金額を下げてでも購入者にお任せしたいと思っています。

隣地との敷地境界問題については、昨年末に土地家屋調査士を挟んで覚書き締結の交渉をしましたが合意してもらえませんでした。これ以上は土地所有者同士で話し合っても進展が無さそうなので、筆界特定制度を利用して法務局に境界決定をしてもらおうと思います。筆界特定制度は1年近く時間がかかりますが、現状はこれが売却への近道である気がしています。

I have been working on selling my parents' home for the past few years. It’s a 50+ year old wooden apartment with no.8 of studio units attached to the side of my family home space. Excepting three units, remaining are vacant, and my father passed away last year, so my 78-year-old mother is currently living alone in the apartment and managing it by herself. A potential buyer has appeared several times, but we have not been able to reach a purchase and sell agreement due to our conditions that buyers can’t accept.

The buyers are all retail real estate investors who are looking to build new apartments, but they are not willing to take the step because they dislike the following points.

  • Three tenants are remain and quitting negotiations are needed.
  • There is no land boundary marker on one side of the front road, and the adjacent building crosses the boundary into our property.

We believe that we can solve the tenant negotiations in a financial compensation, but we are not willing to negotiate with tenants whom we have a long term relationship with, so we would like to leave it to the buyers even if we have to discount.

Regarding the issue of the site boundary with the neighboring land, we negotiated to conclude a memorandum of understanding with a land surveyor at the end of last year, but they did not agree to it. Since there seems to be no progress even if the we continue to discuss it any more, I decided that I would ask Legal Affairs Bureau to decide the boundary. I feel that this is a shortcut to sale at present though it takes nearly one year.
